Terms and conditions

By accessing the Website FreelanceMyWay, you must agree to the following terms.
We allows users to work together online to complete and pay for Projects. We are not a party to any contractual agreements between Buyers and Sellers. We simply facilitate between the parties.

You can not use FreelanceMyWay if are under the age of 16.
All accounts are associated with individuals. Login information should not be shared with anyone. The user that created the account is responsible for all actions associated with that account.

Users must agree that a business name or company name is associated with their Account and real name, Users are solely responsible for all activity with their account. FreelanceMyWay has the right to refuse any account or cancel an account for any reason.

While using the FreelanceMyWay you can not do the following.
Post inappropriate jobs or services.
Break any laws or agreements.
fail to deliver payment for services delivered to you;
fail to deliver Seller Services purchased from you;
post false, fake, offensive or inaccurate content (including personal information);
Post spam distribute viruses or any other technologies that may harmful to FreelanceMyWay Collect information about Users, including email addresses, without their consent and knowledge.
You are not allowed to exchange email addresses and communicate outside of FreelanceMyWay during the bidding process. If you are awarded a job you can then communicate outside of our website. All payment must be completed through FreelanceMyWay. You agree to notify FeelanceMyWay if a client contacts you to arrange payments outside of our website. This action is a violation of terms.

FreelanceMyWay is free to sign up and post a project. If you decide to hire a freelancer to work on your project, we charge you a small project fee based on the amount of the project. For fixed price projects a fee of 2.7%. If you pay the freelancer more than the original bid amount we will also charge the project fee on any overage payments.

For Freelancers FreelanceMyWay is free to sign up and bid on projects.
If you are hired for a particular project we deduct 20% of the total amount as a fee. We deduct this fee from the payment you receive. When you are awarded a job your first payment will be held for 30 Days. After the 30 days your next payment will be held for 15 days. After these probation periods payments will be released within 5 days.

Taxes: You are responsible for paying any taxes depending on the jurisdiction of the services provided.

Limits & Fraud Prevention: We have the right to suspend or ban a user if the funds are suspected to be fraudulent.

Refunds: You can ask for a refund for any money that you have paid into your account, except if the amount to refund relates to a Milestone Payment or fees and charges payable to us. If we agree to the refund, the money will be returned through the same method it was paid.

Withdrawals: Your first withdrawal of funds earned may be delayed for up to 15 to 30 days for security and fraud purposes. We may require you to verify your location and provide other documents before you can withdraw funds.

Chargebacks: Chargebacks are not started by us. A chargeback is initiated by a client. Any chargebacks will results in a loss of funds for both FreelanceMyWay and the freelancer. A chargeback is a transaction reversal meant to serve as a form of consumer protection from fraudulent activity committed by both merchants and individuals. A demand by a credit-card provider for a retailer to make good the loss on a fraudulent or disputed transaction.

Right to Refuse Service: We may close, suspend or limit access to your account without reason. If we determine that you have engaged in fraudulent or illegal activities. If you under-bid on project and try to renegotiate the actual price privately to avoid fees.

User Verification:
At anytime we might request a copy of a Government issued ID (Passport, Driver's License or National ID Card)
or a copy of a recent utility bill showing your name and address that's less than 3 months old.
We might also request a PayPal Account statement showing your PayPal registered name, email address and any relevant transactions.

Milestone Payments: We do not operate an escrow service in relation to our service. We do however, provide a service which allows controlled payments to be made called Milestone Payments. The client and freelancer, both agree that the funds can be claimed by the freelancer.

Disputes With Users: You acknowledge and agree that in the event that a dispute is started between a client and a freelancer that you will first attempt to resolve any issues and work to satisfy each other with a resolution. Any claims or disputes you bring against FreelanceMyWay must be resolved in accordance with the terms of this Agreement.

No Warranty to a User's Identity: We cannot and do not confirm each User's identity on our website. We do provide information about a user, such as a ratings and geographical location. All information is based solely on the data that a user submits. We verify all freelancers requiring them to, verify email, verify phone and submit an application that must be approved by our staff before they can submit proposals.
